I am Dennis Gardener, after 33 years running large hotels I saw the light and joined a profession where I could again look after people and give them advice and “piece of mind” I am passionate about giving people information on a subject that most people think they can “put off till another day”.
Why Should I write a Will?
If you don’t make a will and you die intestate the government have a laid down procedure for the distribution of your assets.
That distribution may not reflect your wishes and will certainly not be tax efficient.
When someone dies it is the people left behind who have to pick up the pieces and that includes sorting out the estate. The administration is much easier and cheaper if there is an up to date valid will.
Everyone should have a will no matter how small their estate is.
You can take the pressure off your loved ones by detailing your specific funeral arrangements (hymns, burial or cremation etc.) and even pre paying your funeral expenses.
You can give specific items which maybe valuable or just sentimental to friends and gift money to favourite charities.
In modern times many couples live together unmarried. Neither partner has any legal right to the others estate without a will.
Step children need protection also. Only legally adopted children have the same rights as blood children.
In Scotland, marriage does not revoke a previous will, so as you can imagine it is extremely important to rewrite it after settling with a new partner.
You can appoint guardians to look after your children up to the age of 16 (18 in England) should something happen to you and your partner in an accident. You can also appoint trustees to look after the children’s money until they have reached a more mature and sensible age such as 21 or 25.
In Scotland you can make a valid will from the age of just 12. In England you need to be 18 (unless you are in the armed forces).

To my family:
I hereby leave you all several months; maybe years of financial hardship and hassle while you sort out my affairs.
To my spouse:
I hereby leave you most (but perhaps not all) of everything that I own.
To my children:
I hereby leave you the remainder of my estate and I give you authority to enforce the sale of any part of it (including the family home) to realise your inheritance.
To the taxman:
I hereby leave you ALL the tax that I could have avoided if I had done the necessary planning.
To my bank and/or solicitor:
I herby give you the authority to charge my estate whatever you feel is necessary to sort out the mess that I leave behind. I realise that this could make you one of the major beneficiaries of my estate.
To anybody else:
I leave you nothing.
